The Legislative Requirement That Zoning and Land Use Controls Be Consistent with an Independently Adopted Local Comprehensive Plan: A Model Statute

This Essay critically reviews the history of the “in accordance with a comprehensive plan” language in the Standard State Zoning Enabling Act and its companion, the Standard City Planning Enabling Act, drafted by an advisory committee of the U.S. Department of Commerce in the 1920s. It then discusses contemporary consistency requirements in state planning and land use enabling statutes. Finally, it presents a model statute intended to clarify the relationship between the local comprehensive plan and various types of land use decisions and actions

A Response to William A. Fischel

This response paper addresses Dr. Fischel\u27s critique of four points about the American Planning Association\u27s (APA) amicus curiae brief: (1) The APA is not concerned about the overall impact of growth management systems that restrict the pace of development and therefore boost the cost of housing on a metropolitan basis; (2) a monetary damages remedy for an interim taking from excessive land use controls is a better solution than the builder\u27s remedy, which is court permission to allow the plaintiff/ developer to construct a housing project in which housing units are set aside for low- and moderate-income persons; (3) mandatory inclusionary zoning allows communities, once they have fulfilled their fairshare objective, to act in an exclusionary manner toward market rate development; and (4) exclusionary zoning is somehow justifiable because everyone does it

ExoPranayama: a biofeedback-driven actuated environment for supporting yoga breathing practices

Both breathing and internal self-awareness are an integral part of any yoga practice. We describe and discuss the development of ExoPranayama, an actuated environment that physically manifests users’ breathing in yoga. Through a series of trials with yoga practitioners and expert teachers, we explore its role in the practice of yoga. Our interview results reveal that biofeedback through the environment supported teaching and improved self-awareness, but it impacted group cohesion. Two practical uses of the technology emerged for supporting breath control in yoga: (1) biofeedback can provide new information about users’ current internal states; (2) machine-driven feedback provides users with a future state or goal, and leads to improved cohesiveness

Advocating Affordable Housing in New Hampshire: The Amicus Curiae Brief of the American Planning Association in Wayne Britton v. Town of Chester

In June 1990, The American Planning Association, a national Washington, D.C. based non-profit association of 27,000 professional planners, elected and appointed planning officials, and citizens interested in improving urban and rural planning filed this amicus curiae brief with the New Hampshire Supreme Court. The case on appeal is Wayne Britton v. Town of Chester, No. 85-E-342 (N.H. Super. Ct. June 27, 1989), brought by a builder/developer and low-income plaintiffs in need of affordable housing in Chester, New Hampshire

Characterization of the C-Terminal Nuclease Domain of Herpes Simplex Virus pUL15 as a Target of Nucleotidyltransferase Inhibitors

The natural product α-hydroxytropolones manicol and β-thujaplicinol inhibit replication of herpes simplex viruses 1 and 2 (HSV-1 and HSV-2, respectively) at nontoxic concentrations. Because these were originally developed as divalent metal-sequestering inhibitors of the ribonuclease H activity of HIV-1 reverse transcriptase, α-hydroxytropolones likely target related HSV proteins of the nucleotidyltransferase (NTase) superfamily, which share an “RNase H-like” fold. One potential candidate is pUL15, a component of the viral terminase molecular motor complex, whose C-terminal nuclease domain, pUL15C, has recently been crystallized. Crystallography also provided a working model for DNA occupancy of the nuclease active site, suggesting potential protein–nucleic acid contacts over a region of ∼14 bp. In this work, we extend crystallographic analysis by examining pUL15C-mediated hydrolysis of short, closely related DNA duplexes. In addition to defining a minimal substrate length, this strategy facilitated construction of a dual-probe fluorescence assay for rapid kinetic analysis of wild-type and mutant nucleases. On the basis of its proposed role in binding the phosphate backbone, studies with pUL15C variant Lys700Ala showed that this mutation affected neither binding of duplex DNA nor binding of small molecule to the active site but caused a 17-fold reduction in the turnover rate (kcat), possibly by slowing conversion of the enzyme–substrate complex to the enzyme–product complex and/or inhibiting dissociation from the hydrolysis product. Finally, with a view of pUL15-associated nuclease activity as an antiviral target, the dual-probe fluorescence assay, in combination with differential scanning fluorimetry, was used to demonstrate inhibition by several classes of small molecules that target divalent metal at the active site
